In an extensive plan to restructure the Supreme Court, US President Joe Biden has urged legislators to impose term limits and create an ethics code “to restore trust and accountability” among the court’s nine members.

With its nine unelected members who can serve for life, the conservative-leaning court has evolved into a political battleground in recent years, with significant influence over issues ranging from the environment to abortion rights.

How the Supreme Court turned into a combat zone

Mr. Biden stated that “what is happening now is not normal” in an opinion article that was published in the Washington Post on Monday morning.

“It undermines the public’s confidence in the court’s decisions, including those impacting personal freedoms,” he wrote in the Washington Post. “We now stand in a breach.”

Mr. Biden has suggested terminating lifetime appointments to the court in order to allay these worries.

Rather, he thinks that every two years, current presidents ought to name a new justice to the court, who would then hold office for eighteen years.
Stacked 18-year term restrictions have been proposed by reformers as a way to depoliticize the court and make it more impartial and representative of the public.
Mr. Biden is also pushing Congress to create a new code of ethics that would compel judges to reveal gifts and abstain from overt political activity.

Although the court last year established a code of ethics for the first time in its history, the code has no means of enforcement.

The president added, “Every other federal judge is bound by an enforceable code of conduct.” “There is no reason for the Supreme Court to be exempt.”
Last but not least, Mr. Biden wants to modify the US Constitution to overturn a July 1 Supreme Court decision that ex-presidents like Donald Trump are not subject to criminal prosecution.

 

According to the contentious decision, a president is exempt from prosecution for “official acts” but not from prosecution for “unofficial acts.”

The proposed addition, which Mr. Biden named the “No One is Above the Law” amendment, would “make clear that there is no immunity for crimes a former president committed while in office,” according to his opinion article.

“I share our founders’ believe that the president’s power is limited, not absolute,” he stated. “We are a nation of laws – not of kings or dictators” .
The efforts of Republicans to overhaul the court have been rebuffed.

For instance, Senator Lindsey Graham of South Carolina told CBS, the US partner of the BBC, on Sunday that Democrats failed to do so while a more liberal set of judges was “pumping out opinions they liked.”

Trump called attempts to restructure the court “illegal” and “unconstitutional” earlier this month, calling it a “sacred” institution.

“The Democrats are attempting to interfere in our presidential election, and destroy our justice system, by attacking their political opponent, me, and our honourable supreme court,” wrote the senator. “We have to fight for our fair and independent courts, and protect our country.”

Later on Monday afternoon, Mr. Biden is scheduled to speak at an event in Austin, Texas, on his proposed reforms.
